D & B Blocks Social Studies 10 -  Today we are in the library for our next day of research/work on your family history assignment. Remember, your task is to research your family history, which includes learning how to conduct academic research, making critical evaluations regarding sources, and managing information. Please remember that I want you to use the primary documents and stories you find to uncover what daily life might have been like for your relatives. Tuesday's blog entry has lots of links and ideas for you.

C Block Law 12 - Today we will begin Family Law and we'll look at the "Essential" requirements for marriage (age, not currently married, affinity/consanguinity, mental capacity, willingness) and the "Formal" requirements for marriage (age, license, ceremony). Here's an example:

In BC sections 28 & 29 of the Marriage Act [RSBC 1996] Chapter 282 indicates consent is required to marry someone under the age of 19 and forbids marriage to someone under the age of 16. Specifically the act states:

28 (1) Except as provided in subsections (2) to (4), a marriage of a person, not being a widower or widow, who is a minor must not be solemnized, and a licence must not be issued, unless consent in writing to the marriage is first given

(a) by both parents of that person if both are living and are joint guardians, or by the parent having sole guardianship if they are not joint guardians or by the surviving parent if one of them is dead,

(b) if both parents are dead, or if neither parent is a guardian, by a lawfully appointed guardian of that person, or

(c) if both parents are dead, and there is no lawfully appointed guardian, by the Public Guardian and Trustee or the Supreme Court.

29 (1) Except as provided in subsections (2) and (3), a marriage of any person under 16 years of age must not be solemnized, and a licence must not be issued.

(2) If, on application to the Supreme Court, a marriage is shown to be expedient and in the interests of the parties, the court may, in its discretion, make an order authorizing the solemnization of and the issuing of a licence for the marriage of any person under 16 years of age.

If there's time then we'll talk about annulments, divorce, property division and support obligations. We'll look at: the equal division rule and the matrimonial home; spousal support and self sufficiency; and the types of child guardianship, access, and child support.

A Block Criminology 12 - Yesterday we started learning how to identify a pyramid / ponzi scam (for more take a look at How Stuff Works). Remember the pyramidal structure? Next we'll look at individual exploitation of an institutional position, influence peddling & bribery, theft and employee fraud, client fraud and corporate crime. We'll end by watching the first eight sections of the movie "The Corporation". Please do not forget that the documentary is an opinion piece...it is trying to persuade you that a corporation acts like a psychopath. Not all business is bad but we do need to understand the "corporate view" of white collar criminal activity. We'll end the class with a discussion about business and corporate culture. What is it that makes a successful business person and what kind of ethical behaviour is valued by corporate culture? From the Business Ethics Forum blog site:

An outstanding in-depth article on the Value of Corporate Values can be found in an article by Reggie Van Lee, Lisa Fabish, and Nancy McGaw in this month's S+B. Based on a survey at 365 companies in 30 countries, the authors claim "increasingly, companies around the world have adopted formal statements of corporate values, and senior executives now routinely identify ethical behavior, honesty, integrity, and social concerns as top issues on their companies’ agendas". The highlights of the survey and article are:

  1. A large number of companies are making their values explicit. That’s a change — quite a significant change — from corporate practices 10 years ago. The ramifications of this shift are just beginning to be understood.
  2. Ethical behavior is a core component of company activities.
  3. Most companies believe values influence two important strategic areas — relationships and reputation — but do not see the direct link to growth.
  4. Most companies are not measuring their “ROV.”
  5. Top performers consciously connect values and operations.
  6. Values practices vary significantly by (continental) region.
  7. The CEO’s tone really matters.
The article provides quantitative data about these 7 findings and concludes with "A commitment to corporate values may be in vogue, but the public will remain suspicious until corporations both understand and can demonstrate that they are committed to using values to create value". What we are looking at is what makes people abuse the public trust in corporations.
